Buying in a Flood Area in Maitland: What to Check Before You Exchange

Maitland has lived with the Hunter River for 200 years, and it flooded again in 2022 and 2025. Here’s what to check before you’re locked into a property you can’t afford to insure.

What should you check before buying in a Maitland flood area?

Three things, all before you exchange: the flood notations on the planning certificate in the contract, Council’s flood information for the address, and a written insurance quote that includes flood cover. Once contracts are exchanged and cooling-off ends, you’re committed, whatever the insurer says. Buying in a Maitland flood area isn’t a reason to walk away. Buying one blind is.

  • Does Maitland still flood? Yes. In July 2022 the Hunter River at the Belmore Bridge reached about 10.4 metres, just under the 10.5 metre major flood level, and more flooding followed in May 2025.
  • Where do I find out if a property is flood affected? The Section 10.7 planning certificate attached to the contract, plus a flood information certificate from Maitland City Council.
  • When should I get an insurance quote? Before exchange, or at the latest during the cooling-off period. At auction there’s no cooling-off, so get it before auction day.

Why Maitland flood areas need extra care

Maitland sits on the Hunter River floodplain. The 1955 flood took the river to 12.1 metres at the Belmore Bridge and still shapes the city today, from the levees to the flood marker poles around town.

It isn’t only history. In July 2022 the river came within about 10 centimetres of the major flood level, Gillieston Heights was cut off, and roads were closed through East Maitland and Chisholm. The May 2025 floods closed roads again and damaged the new Melville Ford bridge while it was being built.

Council is now updating its Flood Risk Management Study after the 2022 event, so the flood picture for some addresses may change. That’s another reason to check the current information for the specific property, not rely on what a neighbour or a listing says.

What actually happens

Flood risk is mapped on modelled events, not on last year’s weather, so a house that stayed dry in 2022 can still be in a mapped flood area. Premiums are priced on that mapping. And the place flood risk is formally disclosed is the planning certificate in the contract, which is why it needs to be read before you’re committed.

What to check, step by step

Read the flood notations on the planning certificate

Every NSW contract includes a Section 10.7 planning certificate. It states whether flood related development controls apply to the land. If they do, the property is in a mapped flood area. We read this for you when we review the contract and flag it before you exchange.

Get Council’s flood information for the address

Maitland City Council issues flood information certificates that set out whether the property is flood prone, the type and extent of the risk, and any building controls that apply. Council also notes that flooding can happen outside mapped areas in extreme events, so a clear map isn’t a guarantee.

Get a written insurance quote that includes flood

Ask for a quote on the actual address, with flood cover included, and get it in writing. Most home policies now include flood cover as standard, but the price in a flood area can be a shock. A quote takes minutes and tells you the real yearly cost of owning the house.

Talk to your lender about insurance

Your lender will usually want building insurance in place before it funds settlement. If cover is hard to get or very expensive, you want to know that now, not the week before settlement.

Do it all before auction day

At auction there’s no cooling-off period. When the hammer falls you’ve exchanged, so every check above has to be done before you bid.

What if you’ve already exchanged?

If you’re still inside the 5 business day cooling-off period, you can still get the quote and the flood certificate. If the numbers don’t work, you can withdraw, losing 0.25% of the purchase price. That’s a known cost, and far smaller than owning a house you can’t insure.

Once cooling-off ends, you’re bound by the contract. Between exchange and settlement the risk of damage generally stays with the seller under the Conveyancing Act, but from settlement it’s yours, so arrange cover to start on settlement day at the latest.

Example

A buyer in Lorn finds a home they love and the agent says it stayed dry in 2022. The planning certificate shows flood related development controls apply. They get a written quote during cooling-off and the premium is far higher than they expected. They factor it into their budget, confirm their lender is happy, and go ahead knowing the real cost. Same house, no surprises.
